Terms & Conditions

1. Subscription & Fixed Term (6 & 12 Month Minimum Term) Based Clients

These Terms and Conditions (“Terms”) govern your use of the services provided by Web Choice Online Pty Ltd (“we,” “us,” or “our”). By using our services, you agree to comply with and be bound by these Terms.

Your access to and use of our services is conditional upon your acceptance of these Terms. By ticking the “I’ve read & accepted the Terms & Conditions” box during sign-up or by continuing to use our services, you acknowledge that you have read, understood, and agreed to these Terms.

This agreement applies to both subscription-based clients (billed weekly or monthly) and fixed-term agreement clients (minimum terms of 6 or 12 months). The terms and conditions outlined herein will govern your engagement with Web Choice Online Pty Ltd for the duration of your service period.

2. Legal Agreement

This agreement establishes a legally binding contract between the Client (“you”) and Web Choice Online Pty Ltd (“we,” “us,” or “our”). These Terms constitute the entire agreement between both parties regarding the services provided. Any additional terms, including those in purchase orders or other documents submitted by the Client, will not apply unless explicitly agreed upon in writing by Web Choice Online Pty Ltd.

3. Purchases & Payment

Upon sign-up, the initial setup fee will be charged to your nominated payment method. Services will not commence until the payment has been successfully processed.
The setup fee is non-refundable under any circumstances.
Subscription clients will be billed weekly in arrears via automatic payment unless another arrangement has been agreed upon in writing.
Web Choice Online Pty Ltd reserves the right to engage debt collection services at the Client’s expense if invoices remain unpaid for more than 7 days past the due date. Any outstanding balances will incur the maximum enforceable penalty interest rate.

4. Subscription Clients

Subscription clients are billed on a weekly or monthly recurring basis, with payments automatically deducted from the Client’s nominated account.
The first payment is charged 7 days after sign-up, unless otherwise agreed upon in writing.
To pause or cancel the service, the Client must follow the required notice periods outlined below.

5. Fixed-Term Agreements (6 & 12 Month Minimum Terms)

Fixed-term clients agree to a minimum contract period of 6, or 12 months.
Fees will be billed in arrears on a recurring payment schedule, starting 7 days after sign-up.
Upon completion of the minimum term, the contract will automatically renew unless the Client provides written notice of cancellation before the end of the term.
Pausing the service is not allowed during the fixed-term period unless explicitly agreed upon in writing.

6. Pausing Services (For Subscription Clients Only)

Subscription clients may request to pause their services with a minimum 1-week written notice via email.
The maximum pause period is 4 weeks, unless otherwise agreed upon.
A specific resume date will be agreed upon at the time of the pause request.
If the Client fails to resume service after the pause period, Web Choice Online Pty Ltd reserves the right to terminate the account and charge a 4-week cancellation fee.

7. Termination of Service

(A) Subscription Clients

Clients on a weekly or monthly subscription must provide 4 weeks’ written notice via email to terminate services.
Payments will continue until the end of the notice period.
If notice is not provided, a 4-week cancellation fee will be charged to the nominated payment method.
Refunds are not provided for any unused service periods.
If the Client has outstanding payments, Web Choice Online Pty Ltd may engage debt collection services at the Client’s expense.

(B) Fixed-Term Clients (6 & 12 Months)

Clients who have signed a fixed-term agreement (6, or 12 months) cannot cancel early unless they pay the full remaining contract value.
If early termination is requested, the outstanding amount will be charged immediately to the Client’s nominated payment method.
Fixed-term agreements automatically renew at the end of the term unless the Client provides written notice before the renewal date.

8. Sub-Contracting

Web Choice Online Pty Ltd reserves the right to subcontract any service that we have agreed to perform for the Client.
The Client acknowledges that some or all services may be provided by third-party contractors or service providers.

9. Advertising Management Service Terms & Conditions

Web Choice Online Pty Ltd will set up and manage advertising campaigns to the best of our ability.
While we employ best practices, we do not guarantee specific results, including ad placement, cost per click, or the number of conversions.
The Client acknowledges that ad platform changes (such as Google Ads or Facebook Ads) may impact campaign performance, and Web Choice Online Pty Ltd is not responsible for such external factors.

10. Google Ads

Web Choice Online Pty Ltd will create, manage, and optimize Google Ads campaigns on behalf of the Client.
All ad spend is paid directly to Google by the Client.
We do not guarantee specific ad positions, impressions, clicks, or leads.

11. Facebook Ads

Web Choice Online Pty Ltd will manage the Client’s Facebook advertising campaigns to maximize results based on the agreed budget.
Facebook’s policies and algorithm changes may impact campaign performance, and Web Choice Online Pty Ltd is not responsible for these external factors.

12. Landing Pages

If a landing page is required for an advertising campaign, Web Choice Online Pty Ltd will build and optimize it for conversions.
Landing page costs are separate from advertising management fees and must be paid upfront unless included in a custom package.
Any changes to landing pages after approval may incur additional charges.

13. Search Engine Optimization (SEO)

Web Choice Online Pty Ltd provides SEO services to improve website rankings in search engines such as Google.
Due to frequent changes in search engine algorithms, we do not guarantee specific rankings or organic traffic improvements.
SEO results may take several months to become noticeable, and outcomes vary based on competition, website history, and industry trends.

14. SEO Service Scope

Our SEO services include:
- Keyword research & strategy
- On-page optimization (meta titles, descriptions, headers, etc.)
- Technical SEO fixes
- Content recommendations & strategy
- Link-building (if included in the package)
What SEO does not include:
- Paid search advertising (Google Ads, Facebook Ads)
- Social media marketing
- Website redesign or development

15. Definition of SEO

Search Engine Optimization (SEO) is the process of improving a website’s visibility on search engines like Google.
It involves technical optimizations, content improvements, and link-building to increase rankings over time.

16. Disclaimer of Warranties

Web Choice Online Pty Ltd provides all services “as is” without any warranties, express or implied.
We do not guarantee specific marketing results, business growth, or ROI.
External factors such as algorithm changes, competitor activity, and market conditions may impact results.

17. Payment Terms

All payments for services are due as per the agreed schedule (weekly, monthly, or fixed-term).
If a payment is missed or declined, Web Choice Online Pty Ltd reserves the right to suspend all services until the account is brought up to date.
Any overdue payments may be sent to collections, and legal action may be pursued to recover outstanding amounts.

18. Termination of Google Ads Service

Clients must provide 4 weeks’ written notice if they wish to terminate Google Ads services.
The final payment will be processed at the end of the notice period.
Web Choice Online Pty Ltd does not refund any portion of fees already paid.

19. Termination of SEO Service

Clients must provide 4 weeks’ written notice if they wish to terminate their SEO services.
SEO services are non-refundable, and results achieved during the service period will remain in effect until affected by search engine updates.

20. Web Design Services

Web Choice Online Pty Ltd provides website design and development services tailored to the Client’s needs.
Web design fees include a fixed number of revisions, after which additional changes may incur extra costs.
Once a website is delivered and approved, Web Choice Online Pty Ltd is not responsible for any subsequent modifications made by the Client or third parties.

21. Changes to Terms & Pricing

Web Choice Online Pty Ltd reserves the right to update these Terms & Conditions and adjust pricing with 30 days’ notice to Clients.
Clients will be notified of any major changes via email or an announcement on our website.
